The alleged incidents are said to have taken place over a six day period in June and he was arrested at his home in Airdrie last month.

A Police Scotland spokeswoman said: “A 52-year-old man was arrested on Wednesday, September 7. He was released on an undertaking to appear at Airdrie Sheriff Court on Thursday, October 6.”

A spokesman for the Crown Office added: “The Procurator Fiscal has received a report concerning a 52-year-old male in connection with alleged incidents said to have occurred between June 25 and 30.

“The report remains under consideration.”

Fagan has been a councillor since 2003 and sits on several committees including Education, Policy and Resources and Housing and Social Work Services.

He had worked as an assistant to ex-MSP Karen Whitefield and is a former vice-chairman of SPT.

A council spokesman said: “This is a matter for the courts.”
