Scotland’s top prosecutor has announced he wants three men cleared of murdering a waiter to face a re-trial.
The accused include Motherwell man David Montgomery (37). He, Ronnie Coulter (46) and Andrew Coulter (33), both of Wishaw, were charged with murdering Surjit Singh Chhokar by stabbing him outside his home in Overtown in 1998.
All three were cleared afte two separate High Court trials.
Now the Lord Advocate, Frank Mulholland, has applied to the High Court for authority under the Double Jeopardy (Scotland) Act to prosecute them again.
It’s only the second application of its kind since the legislation was introduced three years ago.
Last year the police were instructed by the Crown Office to re-open the investigation of the murder.
