A creep who took pictures of partially naked women while they were sleeping or unconscious through drink has been jailed for 30 months.
James Russell (63), of Baird Place, Bellshill, was convicted at Hamilton Sheriff Court of sexually assaulting two women and filming them without their consent at houses in Bellshill and Mossend.
The films came to light when one of the victims came across them on Russell’s phone in October 2012.
Detective Constable Mark Cummings told Paula Russell, prosecuting, there were hundreds of indecent pictures of the two women.
Russell told officers he knew both women. He insisted they were aware of what he was doing and he would not have done anything without their permission.
DC Cummings said it was clear from the photos that both women were either sleeping or drunk. Russell could be seen groping them as he filmed them with his phone. They had ‘no idea’ what had happened until they saw the images.
Passing sentence, Sheriff David Bicket told Russell: “You took advantage of these women. They were incapable of giving consent because they were either intoxicated or asleep.
“Given the serious nature, I can deal with this only by imposing a custodial sentence.”
